Terms of Service

The deal.

Last updated: April 6, 2026. This is the small-business version of Terms of Service. Plain English. No legalese tricks. If anything here is unclear, email info@caseyaddason.com and ask before you sign up.

01 · Who You're Dealing With

This is one person.

Addason Digital is operated by Casey Addason as a sole proprietor. Based in Santa Fe, New Mexico, USA. Not a corporation. Not an agency with departments. One person plus a stack of tools.

When you contract with Addason Digital, you are contracting with Casey Addason personally. Email: info@caseyaddason.com.

02 · What You Get

The service.

03 · The Engagement

Length, renewal, cancellation.

Three-month minimum. Paid engagements have a 3-month minimum commitment. After 3 months, the engagement converts to month-to-month and you can cancel at any time with 30 days notice.

Cancellation during the first 3 months is allowed but the remaining months of the minimum commitment are still owed. The setup fee is non-refundable in all cases.

Renewal at month 3. 30 days before your engagement ends I send a renewal offer. You can renew at the same plan, upgrade, or graduate. If I don't hear back, the engagement converts to month-to-month at your current plan and you can cancel anytime.

Pause vs cancel. If you need to pause for personal reasons (medical, family, etc.), email me and we will work something out. I am not in the business of holding clients hostage.

04 · The 90-Day Guarantee

If your score doesn't improve, you don't pay.

If your Web Presence Score does not improve over the course of your first 3-month engagement, I will refund every monthly retainer fee you paid. Full refund. No clawback of work I already did. You keep the audit, the dashboard, and any improvements that shipped.

The setup fee is non-refundable because it covers work delivered up front (the deep audit, dashboard build, kickoff call, onboarding).

What "your score doesn't improve" means: the Web Presence Score on your dashboard at month 3 is the same or lower than the score at month 1. If it goes up by even 1 point, the guarantee does not trigger.

What you owe me in return: reasonable cooperation. If you ignore your homework, miss every monthly call, and never reply to my emails, the guarantee is void. The service requires participation.

05 · Billing

How money moves.

Invoices are sent through HoneyBook, my CRM. Each invoice is due on receipt unless we agreed otherwise.

The setup fee is due when you sign the contract. The first month's retainer is due when the engagement starts (or 7 days after the contract is signed, whichever is later).

Subsequent monthly invoices are sent on the same day each month. Late payments accrue at 1% per month after 30 days.

Refunds (when the 90-day guarantee triggers) are issued via the same payment method you used. Most refunds clear within 5 business days.

06 · What You Can't Do

When you use Addason Digital, you agree NOT to:

I want to be very clear about what is NOT included in any plan:

08 · Intellectual Property

Who owns what.

You own everything I produce for you. The audit report, the dashboard data, the changes I ship to your site, the content I write (if applicable). Once it's delivered, it's yours forever. You do not need my permission to keep using it after the engagement ends.

I retain the right to:

If you want me to remove your business from any case studies or marketing materials after the engagement ends, just email me and I will do it within 7 days.

09 · Liability

The legally required language.

Addason Digital is provided "as is" without warranty of any kind, either express or implied. Casey Addason will not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to lost profits, lost revenue, lost data, or lost business opportunity — arising out of or related to your use of the service.

The maximum total liability for any claim related to the service is limited to the amount you paid in the most recent 3 months. If you paid me $1,500 over 3 months and something goes catastrophically wrong, the most you can recover from me is $1,500.

This limitation applies even if I knew or should have known about the possibility of damages. It does not apply to damages caused by my willful misconduct or gross negligence.

This is the standard way small service businesses limit liability. It is not me being shady — it is me being honest about the size of my operation.

10 · Disputes

If something goes wrong.

If we have a dispute, my preference is that we try to work it out by email first. I am a real person and I will respond.

If we cannot resolve it that way, the next step is mediation through a mutually agreed mediator. If mediation fails, the final fallback is arbitration under the rules of the American Arbitration Association in Santa Fe County, New Mexico.

You waive the right to a jury trial and the right to participate in class actions. (This is standard for small service businesses — defending a class action would put me out of business and you out of a service provider.)

11 · Changes to These Terms

How updates work.

If I make a meaningful change to these terms (changed pricing, changed the guarantee, added new restrictions), I will:

Trivial changes (typo fixes, link updates) just get patched without notice.

12 · Governing Law

What law applies.

These terms are governed by the laws of the State of New Mexico, without regard to conflict of laws principles. Any legal action arising out of these terms must be filed in a court of competent jurisdiction in Santa Fe County, New Mexico.
